§1 Scope and Provider
These Terms of Service govern the use of the Therapie Digital platform ("the Service"), operated by therapie.digital ("we", "us"). By creating an account, you agree to these terms. The Service provides digital tools for psychological assessment administration, scoring, and patient progress tracking for licensed therapists and healthcare professionals.
§2 Description of Services
Therapie Digital provides a web-based platform for administering standardized psychological assessments. The Service includes: • Digital administration of validated test instruments (PHQ-9, GAD-7, DASS-21, etc.) • Automated scoring and clinical interpretation • Patient progress tracking with anonymous codes • PDF report generation • Multi-language support The Service is a tool for licensed professionals and does not constitute medical advice, diagnosis, or treatment.
§3 Registration and Account
To use the Service, you must create an account with a valid email address. You must be at least 18 years old and hold appropriate professional qualifications for administering psychological assessments in your jurisdiction. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
§4 Subscription and Payment
The Service offers free and paid subscription plans. Paid subscriptions are billed monthly through our payment provider Mollie B.V. Prices are displayed including applicable VAT. You may upgrade, downgrade, or cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
§5 User Obligations
You agree to: • Use the Service only for lawful professional purposes • Maintain current and accurate account information • Not share your account credentials with unauthorized persons • Comply with applicable professional and data protection regulations • Ensure appropriate informed consent from patients before administering assessments • Not attempt to reverse-engineer, copy, or redistribute the Service
§6 Intellectual Property
The Service, including its design, code, and content, is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. Standardized test instruments are used under applicable licenses and their copyrights belong to their respective authors.
§7 Limitation of Liability
The Service is provided "as is". We do not guarantee uninterrupted or error-free operation. We are not liable for clinical decisions made based on assessment results. Our liability is limited to the amount paid by you in the 12 months preceding the claim. This limitation does not apply to damages caused by intentional misconduct or gross negligence.
§8 Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws (GDPR, BDSG). Patient assessment data is stored using anonymous codes only. For details, please refer to our Privacy Policy.
§9 Termination
You may terminate your account at any time through your account settings. We may terminate or suspend your account if you violate these terms or engage in activities that harm the Service or other users. Upon termination, your data will be deleted in accordance with our Privacy Policy and applicable retention requirements.
§10 Amendments
We may amend these terms with at least 6 weeks' notice. Changes will be communicated via email. If you do not object within 6 weeks of notification, the amended terms are deemed accepted. You will be specifically informed about the right to object and the consequences of silence in the notification.
§11 Right of Withdrawal
As a consumer within the EU, you have the right to withdraw from the contract within 14 days without giving any reason. To exercise this right, you must inform us of your decision by a clear statement (e.g., by email). If you have requested that the Service begin during the withdrawal period and wish to cancel, you may owe a proportionate amount for the service already provided.
§12 Dispute Resolution
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
§13 Severability and Governing Law
If any provision of these terms is found to be invalid, the remaining provisions shall remain in full force and effect. These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of the consumer's country of residence shall apply.
